Apartment Rental Agreement

Example contract as at 1st January 2021.

CHECK-IN TIME : From 4pm (16h) although bags can be dropped off beforehand.

CHECKOUT TIME :  11am or as organised with the Owner.

This is a NON SMOKING property.

PETS are not permitted in this property under any condition.

NOISE / NUISANCE : In Paris there is a noise regulation which means that from 10pm until 8am no-one can make any noise without forewarning to the other members of the building.    This includes loud music, DIY or the use of the washing machine etc.   You agree not to cause any damage to the walls, doors, windows or any other part of the Property nor to do anything that may be reasonably considered to cause a nuisance or annoyance to any other occupier of adjoining or neighbouring properties.

DEPOSIT PAYMENT :

Your booking is confirmed following receipt of a non-refundable DEPOSIT PAYMENT of **€300 up to 25%**.   This payment is a part-payment of your final booking amount and not additional to it.

FINAL PAYMENT :

Due to the Covid19 situation, for reservations for bookings prior to 1st May 2021 your final payment is non-refundable and due in FULL 14 days prior to your arrival. For reservations for bookings after 1st May 2021 the final payment is due 30 days prior to arrival.

SECURITY DEPOSIT :

The security deposit of **€150** is due prior to arrival.   This will be refunded within 24 hours of departure providing that :

No damage is done to property or its contents, beyond normal wear and tear.

1. All keys are left on the dining table or deposited with the Owner.

2. All telephone call charges accrued during the stay are paid prior to departure.

3. No linens are lost or damaged and, due to the Covid19 situation, no additional bedding / linens are used without express agreement from the Owner.

4. No damage has been caused to the walls, doors, windows or any other part of the Property.

MAXIMUM OCCUPANCY :

The maximum number of guests is limited to **four (4)** persons.   You cannot allow more people to stay in the Property than expressly authorised, nor can you change the makeup of the party during your stay in the Property, nor transfer ownership of the contract.  If you do so, the Property may not be handed over to you or you may be required to leave it.  Each of these circumstances will be treated as a cancellation of the Booking by you for which there is no obligation to refund payments already made in those circumstances. Any refund will be at the Owner’s sole discretion.

MINIMUM STAY :

This property requires a **two (2)** night minimum stay. Longer minimum stays may be required over weekends and during holiday periods.

INCLUSIVE FEES :

Rates include a one-time linen & towel setup. Facilities fees (electricity, internet etc) are included in the rental rate. There will be 3 toilet rolls per toilet provided and various items of teas and coffees in the kitchen cupboards.

1. Telephone calls to cell phones in the USA or Canada are included.

2. Telephone calls to landlines in a few countries are not included (the full list is with the Owner). Those that are free include Europe, USA, Canada, Australia, NZ, South Africa…

OBLIGATIONS

You agree to comply with the regulations set out in any printed Welcome document in the Property and any other regulations reasonably specified by us from time to time and ensure that they are observed by all members of your party. You agree to keep and leave the Property and the furnishings, including items such as kitchen equipment, crockery and glasses clean and in good condition.

You agree not to do anything that may be reasonably considered to cause a nuisance or annoyance to any other occupier of adjoining or neighbouring properties.

HOUSEKEEPING :

Linens and bath towels are included in the property (see Inclusive Fees) for your use.  There is a cupboard for extra linens in the bedroom in which extra pillows and their respective pillowcases are stored. Due to the Covid19 situation, please do **not** use the stored towels and duvets without prior agreement, if you do the cost of cleaning those items will be deducted from the Security Deposit.

A maid service is not included in the rental rate however it is available at an additional rate of €20 per hour and can be organised every day or even just once during your stay. Please ask the Owner if you want to include this service.  

TOILETS :

There are 2 toilets in the property.  One is a normal toilet, the other, in the bathroom, uses a Saniflo macerating system so everything other than toilet paper (like dental floss or q-tips etc) should be put in the bin provided.

If a plumber is required because the toilet is blocked your deposit will automatically be forfeited.

YOUR PERSONAL PROPERTY :

You agree to take all necessary steps to safeguard your personal property.  You agree to ensure that each member of your party is covered by comprehensive travel insurance (including cancellation, flight delays, loss and damage to baggage and other property) and health insurance (including evacuation and repatriation coverage).

CANCELLATION :

A deposit payment confirms your booking and blocks my calendar to view for other travellers.  This payment is non-refundable. 

For reservations made for dates prior to 1st May 2021 the residual amount of your booking is due MORE THAN 14 days prior to your arrival. For reservations for bookings after 1st May 2021 the final payment and cancellation date is 30 DAYS PRIOR to arrival. Cancellations made once final payment has been made forfeit these payments. The residual amount of your booking is due MORE THAN 30 days prior to your arrival. Cancellations that are made after final payment forfeit these payments. 

Reimbursement is at the Owner’s discretion if a replacement booking has been found, minus an administration fee of €100.  Every effort will be made to find a replacement booking.

Early departure does not warrant any refund of rent.

ACCESS :

You agree to allow us or any representative of ours access to the Property at any reasonable time during your stay for the purpose of essential repairs or in an emergency.

COMPLAINTS

Every effort has been made to ensure that you have an enjoyable and memorable holiday. If, however, you have any cause for complaint it is important that you contact the Owner as soon as possible so as remedial action can be taken as soon as possible.

LIMIT OF LIABILITY

The maximum liability for losses you suffer is strictly limited to the amounts received by us in relation to your Booking.

We shall not be liable for any losses which are not a foreseeable consequence of us breaching this Booking Contract. Losses are foreseeable where they could be contemplated by you and us at the time your Booking is confirmed by us.

A full refund will be provided if the premises are unavailable due to the presence of the Covid19 virus.

Your Booking is made as a consumer for the purpose of a holiday and you acknowledge that the Owner will not be liable for any business losses howsoever suffered or incurred by you. This does not exclude or limit in any way liability for death or personal injury caused by negligence or for fraudulent misrepresentation; or for any matter for which it would be illegal to exclude or limit, or attempt to exclude or limit, liability.

The Owner will not be in breach of this Booking Contract, or otherwise liable for any failure or delay in performance, arising from any circumstances beyond their reasonable control.
